KOCHI: Ernakulam Central Police filed a case against gold smuggling case, Swapna Suresh lawyer Krishna Raj under Section 295A on a social media post on June 11 .
Section 295A of the Indian Penal Code (IPC) concerns “deliberate and malicious acts, intended to outrage the religious feelings of any class by insulting their religion or religious beliefs”. The charge was brought against him for his Facebook post against a Kerala State Road Transport Corporation (KSRTC) bus driver who was allegedly dressed in Muslim religious attire.
Krishna Raj alleged in the Facebook post that the driver was driving a bus that goes from Kondotty (in Malappuram district) to Kabul (in Afghanistan).
The case was registered in a complaint filed by lawyer Anoop VR, who hails from Thrissur.
The main defendant in the gold smuggling case, Swapna Suresh, had made an emotional appeal to the media here on June 11 following the potential arrest of her lawyer, R Krishna Raj, saying ‘don’t hurt the people around me.”
According to Swapna, this is a deliberate attempt to isolate him. “Why are they attacking me like this. I stand by the statement I made. Do not hurt the people around me. Hurt me, please kill me so that l story ends,” she said. Why are you doing this to my lawyer too now? Shaj Kiran told us the lawyer will be assigned, the case will be brought against him,” she added.

The Kerala gold smuggling case concerns the smuggling of gold into the state through diplomatic channels. It had been revealed after 30 kg of gold worth Rs 14.82 crore smuggled in a camouflaged consignment as diplomatic baggage was dismantled by Thiruvananthapuram Customs Department on July 5, 2020.
Swapna Suresh alleged that in 2016, Mr Sivasankar, the former principal secretary to Kerala Chief Minister Pinarayi Vijayan, asked him to send luggage to Dubai which belonged to Vijayan. However, when the bag was brought to the consulate, it was found to contain currency and all gold smuggling had started from then.
